Terms of Service

By commissioning the artist (Yuika Nya), you are agreeing to the following terms of service, unless otherwise agreed upon.

Ownership

• All rights of the produced artwork belongs to the artist.
• Artist may use the deliverables in these areas:
- Posting on social media
- Streaming
- Self promotional materials
- Publishing of books

Usage of Deliverables

• Clients are permitted to use the deliverables for the following:
- Personal use
- Streaming assets
- Promotional material (with proper credit given to artist)• Clients are not permitted to use deliverables for the following:
- Taking credit for the creation of the artwork
- Altering the artwork extensively without artist consent
- Non-fungible tokens (NFT) and any form of cryptocurrency
- Feeding any of the artwork produced in the process into an Artificial Intelligence (AI) Art generator.• Rights of the artwork will be revoked if any of the following above are violated.• Merchandise fee will be required if artwork is used in production of merchandise.

Commission Process & Communication

• Commission slot reservations are taken up to a maximum of 6 months prior to commencement date of commission.
• Major revisions (e.g changing pose, etc.) may be requested without any fee in the early stages (mainly drafting). Requesting major revisions in the later stages (lining / colouring, etc.) of the process which require lots of work may incur additional revision fees.
• Work in progress updates will be given to the client at least once a week.
• Clients are to maintain communicative throughout the process to facilitate progress during the commission. If there are no response for:
- 7 days: Commission will be put to a dormant state.
- 14 days: Termination of commission service without refunds.
• Any delays will be informed to the client.
• Deliverables will be available to download for 14 days.

Payment

• Payment plan: 50% (start commission), 50% (delivery)
• If there is a queue: 10% (slot reservation), 40% (start commission), 50% (delivery)
• For commission slot reservation: Slot reservation will be temporary held for the client up to 5 days from the day which the invoice is issued. If there is no response or payment made, the commission slot will be released.
• Clients are required to send payment within 3 days after an invoice is issued, unless agreed otherwise
• Payment in USD accepted through PayPal only.

Cancellation & Refund Policy

• Reservation fee is non-refundable unless initiated by the artist due to schedule conflict.
• Artist reserves the right to terminate and refund the commission at any time.
• Clients may cancel their order before any payment has been made.
• Once payment is received, clients may not request any refunds under any circumstances from the artist.
• If the Artist is unable to complete the commission by the agreed deadline, the client may choose to discuss the refund with the artist based on the amount of work completed.
